The SMS template assists in compliance with national regulators, such as:

US Coast Guard (USCG)

Passenger Vessels: The Coast Guard promote the use of Safety Management Systems (SMSs) to improve safety and reduce marine casualties on board passenger vessels. A Safety Management System that has been implemented must meet the requirements of 33 CFR part 96. In the wake of a series of major marine casualties involving loss of life, and various safety recommendations from the National Transportation Safety Board (“NTSB”), the U.S. Coast Guard is now poised to propose new regulations for domestic passenger vessels.

Towing Vessels: U.S.-flag towing vessels that are engaged in pushing, pulling or hauling alongside are subject to Subchapter M. This part of the Code of Federal Regulations was developed as a response on, among others, two major towing vessel incidents in U.S. waters in the early 2000’s. After these two major incidents the Coast Guard and Maritime Transportation Act of 2004 reclassified towing vessels as vessels subject to inspection and specific requirements were established for a safety management system.

United Kingdom Maritime Coastguard Agency

United Kingdom Maritime Coastguard Agency (MCA) state the requirements for vessels operating in the United Kingdom to have a Safety Management System on board in various Marine Guidance Notices and Merchant Shipping Notices.

Domestic Passengers Ships, Fishing Vessels and Workboats operating under this code are recommended to implement a Safety Management System (SMS) which complies with the principles of the ISM Code, but is commensurate with the size and complexity of the vessels and company’s operations

Canada’s Transport Canada

Transport Canada recommends the implementation of safety management systems (SMS) throughout the Canadian vessel fleet. Many Canadian operators have voluntarily put in place safety management systems that follow the requirements of the ISM Code.

Australia

Australian AMSA Marine Order 504

All Australian Domestic Commercial Vessels (DCVs) must have a SMS. This system is required to demonstrate and document how your vessel meets the mandatory general safety duties and requirements as set out by AMSA

Superyachts Mini-ISM

A mini-ISM is a safety management system based on the ISM Code but tailored specifically to the needs of commercial yachts or vessels registered as private with limited charter usage over 24 meters and under 500GT which otherwise, under international maritime law, have to comply with a full ISM system.

The ISM Code stands for the International Safety Management Code. The ISM Code provides an international standard for the safe management and operation of ships and for pollution prevention.

Purpose

The purpose of a mini-ISM system is to:

  • Promote and ensure safety at sea for the yacht’s crew and guests and third parties
  • Prevent human injury or loss of life to the yacht’s crew, guests and third parties
  • Avoid damage to the yacht
  • Avoid damage to the environment

Requirements

The requirements of a mini-ISM have been summarized by flag states as part of the rules and regulations governing the operation of commercial yachts over 24 meters in length. The Ocean Time Marine Super Yacht SMS template is based on the requirements for a mini ISM System.

The operational requirements of the system are as follows:

  • It should be simple and easy to understand by all users
  • It must be yacht specific and be owned by and developed by the yacht
  • It must be used and updated (during annual flag state surveys the system will be checked to ensure that it is being used)
  • It must be reviewed every three years
